Terms and Conditions

Terms and Conditions for CHIU YUEN SHING AIRCONDITIONING LTD (hereinafter referred to as the“our company”) 

 

General Terms and Conditions

  1. The customers shall pay our company the full price of the product or any balance before the delivery of the product. If the balance of the price is not paid by the customers upon delivery of the product, our company shall be entitled to forfeit the deposit paid by the customer and withhold the delivery of the product.
  2. Title to the product shall remain vested in our company until our company had received full payment of the price and risk shall pass to the customers upon delivery of the product.
  3. All delivery dates and items quoted by our company shall not be liable for any loss or damage incurred or suffered by the customer as a result of late delivery of the product.
  4. In order to confirm each payment accurately, if the customer selects bank transfer or FPS as payment method, an additional random charge will be added to every bill. Customer will finish payment according to the total amount adjusted, so that the order can be confirmed as soon as possible.
  5. The customers confirm and agree that the information provided by the customer is correct.
  6. Our company shall under no circumstances be liable for any loss (whether direct or indirect) of revenue, loss of profits or any indirect or consequential loss whatsoever suffered, sustained or incurred by the customers or by other person arising (directly or indirectly) from or out of or relating to these Terms and Conditions.
  7. Our company reserves the right to amend the Terms and Conditions without prior notice. All matters and disputes are subject to the final decision of our company.
  8. The customers shall not assign, transfer or otherwise any of its rights and obligations under these Terms and Conditions to any other third party without the prior written consent of our company.
  9.  Our company shall not be liable for any loss or damage resulting from delay or failure to perform any or all of these Terms and Conditions where such delay or failure shall be due to causes beyond its control including without limitation to war, riots, acts of God, restraints imposed by governments or any other industrial or trade disputes and other natural calamities.
  10. No failure or delay on the part of each party to exercise any right, power or remedy under these Terms and Conditions shall operate as a waiver, nor shall any single or partial exercise by either of the party of any right, power or remedy. The rights, powers and remedies provided in these Terms and Conditions are cumulative and are not exclusive of any rights, powers or remedies by law.
  11. If any provision of these Terms and Conditions shall be construed to be illegal or invalid, they shall be removed from these terms and shall not affect the legality, validity and enforceability of the other provisions under these Terms and Conditions.
  12. These Terms and Conditions embody the entire agreement between the customers and our company, and they supersede all previous negotiations, representations understanding and agreement between the parties.
  13. These Terms and Conditions are written in both English and Chinese. In the event of any discrepancy between the English and Chinese versions of these Terms and Conditions, the English version shall prevail.

 


Terms and Conditions of Product Warranty ​

  1. Valid warranty card and original purchase invoice must be presented upon request of warranty service and the service is only providing free inspection (All parts, labour fee are not included and must be paid by customer)
  2. This service is not applicable for conditions listed as below:
    - Any products cannot be powered up
    - Any external, internal and visual damages / distortion which includes but not limited to defective pixel, chromatism found on product.
    - Accidental damage, neglect, misuse, inadequate volt input, improper installation or testing, unauthorized repair, alteration. Damages directly or indirectly caused by using improper or damaged facility.
    - Any torn-off, alteration or broken on the original warranty label. (Any applicable)
    - Any software upgrade / downgrade / modification (High-risk actions) made on the products by customer / the Company (on behalf of / requested by customer) which leads to any malfunction / suspicious scenarios.
    - Customer presents false warranty information. However, if the Company at its sole discretion determines the product to be serviceable, the customer may elect to have the product serviced, repaired, or replaced at a cost set forth by the Company. Any replaced parts will become the property of the Company.
  3. This warranty does not cover consumable items such as such as housing, cover, connection cables, corded headsets, plastic ear hooks, build-in batteries, AC adaptor etc.
  4. Any defective part, which has been replaced, shall become our property, scratch may occur on the chassis during repair service.
  5. This warranty is only applicable in Hong Kong.
  6. If the product or its parts are no longer manufactured or the defect cannot be rectified, customer accepts that the Company is absolved from any duty to repair / replace the product under warranty.
  7. Warranty cards / Purchase invoices issued with packing by any entity other than the Company are invalid and will not be accepted.
  8. Warranty card will not be re-issued, please keep this customer copy and present it along with the original purchase invoice for any repair services.
  9. Our company reserves the right to amend the Terms and Conditions without prior notice. All matters and disputes are subject to the final decision of our company.

 


Terms and Conditions of Promotional Code, Coupon Code and Coupon
The promotional codes, discount codes and coupons provided by the company are only applicable to one-time purchases through our website or physical store and are subject to terms and conditions.
Promotional codes, discount codes and coupons are neither refundable nor exchangeable for cash, and the remaining unused amount will be forfeited.
If the customer's order is cancelled for any reason or is eligible for a refund, the promotional code, coupon code or coupon used in the order will be invalid, and the company does not need to refund or make any compensation on it.

 



Personal Information Collection Statement

As a customer of our company, it may be necessary for you to provide us with your personal information (“personal data”) when you apply to us and/or continue to subscribe with us for a service and/or product (“services”). If your personal data is incomplete or incorrect, we may not be able to provide or continue to provide the Services to you. We shall keep your personal data confidential at all times.   5. Enabling the daily operation of your account and/or the collection of amounts outstanding in your account in relation to the Services;
  6. Provide you with regular communications from us with details of the Services and its benefits;
  7. Designing new, or improving existing, Services provided our subsidiaries, our affiliates or us to you;
  8. Investigation of complaints, suspected suspicious transactions and research for service improvement;
  9. Prevention or detection of crime;
  10. Aggregated behavioral analysis.

You have the right to check whether we hold any of your personal data; access your personal data held by us; require us to correct any personal data which is inaccurate; ascertain our policies and practices (from time to time) in relation to personal data and the types of personal data held by us.
